Why this is the correct answer
Freedom of the press is protected by Article 5 of the Basic Law as a fundamental right. Fundamental rights can only be restricted in very narrow, constitutionally defined circumstances — they cannot simply be abolished by a parliamentary majority. Even a party that wins a majority in the Bundestag cannot vote away a core fundamental right, because Article 79 prohibits amendments that undermine the basic structure of the constitution.
